Habih pakat kena kencing dengan MO1...

Rupa-rupanya peruntukan untuk bayaran itu tidak dimasukkan dalam belanjawan semasa ia dibentangkan di parlimen pada 2017.

Janji bonus raya Najib tahun lalu belum boleh ditepati.

Kerajaan mendedahkan janji pemberian bonus Aidilfitri kepada kakitangan awam oleh Datuk Seri Najib Razak di Dewan Rakyat pada Okt 2017 tiada dalam peruntukan belanjawan negara.

Dalam kenyataannya hari ini Kementerian Kewangan menjelaskan Bayaran Khas Aidilfitri 2018 yang disebut Najib semasa beliau membentangkan belanjawan itu tidak lebih sekadar pengumuman biasa.

"Sebenarnya peruntukan bagi pengumuman bayaran tersebut tidak disediakan dalam Bajet 2018. Perkara ini telah disahkan oleh Pejabat Akauntan Negara," kata kenyataan berkenaan.

Justeru, kata Kementerian Kewangan, peruntukan bagi menyalurkan bayaran khas berkenaan masih perlu mendapat kelulusan parlimen.

Hal itu katanya turut disahkan oleh Akauntan Negara Datuk Saat Esa.

Peruntukan berkenaan, kata Kementerian Kewangan, perlu dibentang sebagai Rang Undang-undang Perbekalan Tambahan 2018 dan diluluskan apabila Dewan Rakyat bersidang pada Julai nanti.

"Maka, kenyataan Menteri Kewangan baru-baru ini bahawa peruntukan tambahan atau Rang Undang-undang Akta Perbekalan Tambahan untuk bayaran khas Aidilfitri kepada penjawat awam dan pesara masih perlu diluluskan dalam sidang parlimen Julai ini adalah tepat," katanya.

Tempoh Md Raus Sharif sebagai ketua hakim negara mungkin berakhir menerusi keputusan Mahkamah Persekutuan terhadap cabaran perlembagaan dikemukakan Majlis Peguam terhadap pelantikannya, kata peguam.

Mereka percaya keputusan tentang perlembagaan akan menyebabkan mahkamah tertinggi itu berpihak kepada Majlis Peguam, yang memfailkan cabaran undang-undang itu pada Oktober.

Pada 14 Mac, panel tujuh hakim mendengar permohonan rujukan Majlis Peguam dan Persatuan Peguam Sarawak (SAA), tetapi menunda keputusan mereka.

Kumpulan peguam itu memohon deklarasi bahawa terma lanjutan jawatan Raus dan Presiden Mahkamah Rayuan Zulkefli Ahmad Makinudin sebagai tidak berperlembagaan dan meminta mereka dipecat.

Hakim Hasan Lah mengetuai panel yang terdiri daripada hakim Zainun Ali, Ramly Ali, Azahar Mohamed, Zaharah Ibrahim, Balia Yusof Wahi, Aziah Ali dan Alizatul Khair Osman Khairuddin.

“Keputusan tertunda bermakna perbicaraan sudah selesai tetapi panel mengambil masa untuk menyampaikan keputusan,” kata Timbalan Pengerusi Bersama jawatankuasa undang-undang perlembagaan Persekutuan Badan Peguam Malaysia, Lim Wei Jiet.

“Maka pengumuman oleh mahkamah tertinggi Malaysia dan ketua hakim dan pejabat presiden mahkamah rayuan dikosongkan dengan serta-merta.”

Suruhanjaya Pelantikan Kehakiman perlu mencadangkan nama untuk mengisi kedua-dua jawatan itu kepada perdana menteri, yang kemudian akan menasihatkan Yang di-Pertuan Agong untuk melantik dua hakim tertinggi negara.

Raus dan Zulkefli dilantik sebagai hakim tambahan pada Julai tahun lalu, dan kekal dengan jawatan itu melepasi usia persaraan mandatori 66 tahun dan enam bulan.

Raus dilantik sebagai ketua hakim pada 1 April tahun lalu, dan Zulkefli presiden mahkamah rayuan, tiga hari kemudian pada 4 April. Nama mereka disyorkan oleh Pejabat Perdana Menteri ketika pentadbiran Najib Razak. - malaysianinsight

A Sarawak DAP Youth leader has shot down claims by Chief Minister Abang Johari Abang Openg that the state will regain full ownership of its oil and gas resources.

In a statement, Sarawak DAP Youth publicity secretary Abdul Aziz Isa said this follows Petronas seeking a court declaration that it is the exclusive owner of petroleum resources and sole industry regulator throughout Malaysia – including Sarawak.

“Without a shadow of a doubt, this (legal application) proves that the chief minister had blatantly lied to Sarawakians when he claimed that Sarawak will regain rights to fully exploit oil and gas resources and other resources constitutionally under the State List as per the Ninth Schedule of the Federal Constitution,” he said.

Petronas also wants the Petroleum Development Act (PDA) 1974 to be declared the de facto law governing the industry.

“He (Abang Johari) didn't just lie once but twice.

“The second lie was when he claimed that the then-prime minister Najib Abdul Razak had agreed to return the state's power over its natural resources including oil and gas that had been inadvertently eroded over the years.”

Aziz said that Sarawak BN should have instead pushed for amendments to Section 2(1) and Section 6(1) of PDA – which would have restored the state’s rights to its resources – while BN still held federal power.

“By virtue of the provisions of the PDA 1974, the ultimate ownership and control of the oil and gas industry in Sarawak remains with Petronas, and the prime minister (since Petronas was put under the Prime Minister's Department)."

Regulate, but not own

Aziz also pointed out that Sarawak’s Oil Mining Ordinance 1958 vests the state with full autonomy over its oil and gas resources, yet it has only been granted regulatory powers by the federal government to date.

“We are not talking about regulatory authority, but ‘ownership’ of all our oil and gas resources. We may have regulatory authority to manage our oil and gas resources, but do we own them?

“If Sarawak already had full ownership of its oil and gas resources, Sarawak need not pay the five percent royalty.

“In my humble opinion, Abang Johari is avoiding the real issue which is the ‘ownership’ of oil and gas found in Sarawak,” he said.

Petronas' decision to seek the declaration comes just a month before the Sarawak government is scheduled to assume full regulatory authority over the upstream and downstream aspects of the industry through Petroleum Sarawak Bhd (Petros).

Abang Johari had launched Petros to much fanfare prior to the May 9 elections.

At the time, he claimed Najib had agreed to return oil rights to the state. - mk
